Madde 1 – Taraflar
1.1 Satıcı: ArveNova Software & Technology Ltd. (bilgiler yukarıda).
1.2 Alıcı: Platform'da hesabı bulunan ve sipariş formunda bilgileri yer alan kişi ("Kullanıcı").

Madde 2 – Konu
Bu sözleşme, Kullanıcı'nın Platform üzerinden satın aldığı Pro veya Pro+ paketine ilişkin hak ve yükümlülükleri düzenler. Ön Bilgilendirme Formu bu sözleşmenin ayrılmaz parçasıdır.

Madde 3 – Hizmetin niteliği
3.1 Pro (14,99 €, KDV dahil): 2 Kredi.
3.2 Pro+ (34,99 €, KDV dahil): 5 Kredi + Ayrıntılı Kariyer Raporu (güçlü yönler, gelişim alanları, yetkinlik kırılımı, kariyer raporu). Ayrıntılı Kariyer Raporu yalnızca Kullanıcı'ya gösterilir.
3.3 Her Kredi, işverenin AI mülakat kanalını açtığı ve Kullanıcı'nın başvurduğu bir ilanda bir AI mülakata girme hakkı verir. AI mülakat, yapay zekâ destekli bir avatar ile yapılan görüntülü/sesli bir görüşmedir ve Kullanıcı'nın kendi seçtiği zamanda yapılabilir.
3.4 AI mülakat bir kolaylık seçeneğidir ve isteğe bağlıdır. Başvuru, eşleşme skoru, işverenin canlı (online) mülakatı ve şirkette yüz yüze görüşme her ilanda ücretsizdir. Kullanıcı AI mülakatı seçmek zorunda değildir; seçmemesi başvurusunu olumsuz etkilemez.
3.5 AI mülakat sonucunda üretilen puan ve rapor, işverene yalnızca bilgi olarak sunulur; başvurunun durumunu veya sıralamayı otomatik olarak değiştirmez. İşe alım kararını işveren verir. Kullanıcı'nın Kredi satın almış olduğu işverene gösterilmez ve sıralamada avantaj sağlamaz.
3.6 ArveNova işe alım veya işe yerleştirme garantisi vermez.

Madde 4 – Fiyat ve ödeme
4.1 Fiyatlar Euro cinsinden ve KDV dahil gösterilir.
4.2 Ödeme yöntemleri: (a) web üzerinden ön ödemeli banka havalesi/EFT/SWIFT (Havale ile Ödeme Koşulları uygulanır); (b) mobil uygulamada Apple App Store veya Google Play uygulama içi satın alma (ilgili mağazanın koşulları uygulanır).
4.3 Satın alma tarihinden sonraki fiyat değişiklikleri önceden satın alınmış Kredileri etkilemez.

Madde 5 – Sözleşmenin kurulması ve ifa
5.1 Havale ile ödemede sözleşme, ödemenin hesabımıza geçmesi ve siparişin onaylanmasıyla kurulur. Krediler, ödemenin hesabımıza geçmesini izleyen en geç 2 iş günü içinde tanımlanır ve e-posta ile bildirilir.
5.2 Uygulama içi satın almada Krediler, mağaza ödemeyi onayladığında derhal tanımlanır.
5.3 Bu sözleşme, Ön Bilgilendirme Formu ve (varsa) cayma istisnasına ilişkin beyanınız, Kredilerin tanımlanmasından sonra ve her halükârda ilk AI mülakattan önce e-posta ile PDF olarak tarafınıza gönderilir.

Madde 6 – Kredilerin kullanımı ve geçerliliği
Kredi Koşulları (Metin 5) uygulanır. Özetle: Krediler 12 ay geçerlidir, kişiye özeldir, devredilemez, nakde çevrilemez. Yasal iade haklarınız saklıdır.

Madde 7 – Cayma hakkı
7.1 Kredilerin tanımlandığı tarihten itibaren 14 gün içinde gerekçe göstermeksizin ve cezai şart ödemeksizin cayabilirsiniz.
7.2 Kullanılan Krediler: Cayma süresi içinde, açık talebinizle ve cayma hakkını kaybedeceğinizi kabul etmeniz üzerine başlatılıp tamamlanan AI mülakatlar ile size sunulan Ayrıntılı Kariyer Raporu bakımından cayma hakkı sona erer. Cayma hâlinde bunların bedeli düşülür; kullanılmamış Kredilerin bedeli iade edilir.
7.3 Bildirim: info@meetarven.ai, meetarven.ai/withdrawal-form adresindeki cayma formu veya yazılı bildirim. Ön Bilgilendirme Formu'ndaki örnek form kullanılabilir.
7.4 İade: Bildirimin bize ulaşmasından itibaren 14 gün içinde, ödeme yaptığınız yöntemle ve size hiçbir masraf ya da kesinti yansıtılmadan yapılır. Havale iadelerinde banka ve SWIFT masrafları ArveNova'ya aittir.
7.5 İade tutarı: Hiç Kredi kullanılmadıysa ödenen tutarın tamamı. Kısmen kullanıldıysa: Pro'da kullanılmamış kredi başına 7,495 €; Pro+'da kullanılmamış kredi başına 5,99 € ve rapor sunulmadıysa ayrıca 5,04 € (en yakın sente yuvarlanır).
7.6 Uygulama içi satın almalarda cayma ve iade talepleri ilgili mağaza üzerinden yapılır. Mağaza iadesi gerçekleştiğinde ilgili kullanılmamış Krediler hesabınızdan düşülür. Mağazanın karşılamadığı cayma talepleriniz için info@meetarven.ai adresine başvurabilirsiniz; bu durumda iade Kredi Koşulları md. 7'ye göre yapılır. Emredici tüketici haklarınız saklıdır.

Madde 8 – Kredinin iadesi gereken haller
Aşağıdaki hallerde ilgili Kredi hesabınıza iade edilir:
(a) bizden kaynaklı teknik bir arıza nedeniyle mülakat başlamaz, yarıda kesilir veya rapor üretilemezse ve bu durum tarafımızca tespit edilir ya da tarafınızca bildirilirse;
(b) Kredi kullanıldıktan sonra mülakat başlamadan önce işveren ilanı kapatır veya AI kanalını kapatırsa.
Bu iade yalnızca adayın kendi Kredisine ilişkindir; işverene herhangi bir ücret iadesi yapılmaz.
Kredinizi kullanamayacak durumdaysanız para iadesi talep edebilirsiniz (İade Politikası, Metin 4).

Madde 9 – Kullanıcının yükümlülükleri
Kullanıcı AI mülakata bizzat girer; başkasının adına mülakata girmez, başkasının yardımını veya yanıt üreten araçları gizlice kullanmaz, sistemi kötüye kullanmaz, avatar veya içerikleri kaydedip yayınlamaz.

Madde 10 – Sorumluluk
Yapay zekâ çıktıları (puan, geri bildirim, rapor) bilgilendirici niteliktedir, mesleki kariyer danışmanlığı yerine geçmez ve belirli bir işe alım sonucunu garanti etmez. Kanunen sınırlandırılamayan sorumluluklar saklıdır.

Madde 11 – Kişisel veriler
Kişisel verileriniz Aydınlatma Metni ve Gizlilik Politikası'na (meetarven.ai/privacy-policy) göre işlenir.

Madde 12 – Uygulanacak hukuk ve uyuşmazlıklar
12.1 Bu sözleşmeye KKTC hukuku uygulanır. Bu seçim, mutad meskeninizin bulunduğu ülkenin tüketiciyi koruyan emredici hükümlerinin sağladığı korumayı ortadan kaldırmaz.
12.2 Şikâyetleriniz için önce info@meetarven.ai adresine başvurabilirsiniz. KKTC'de ikamet eden tüketiciler KKTC'nin yetkili tüketici makamlarına ve mahkemelerine başvurabilir.
12.3 Dil. Türkçe ve İngilizce metinler arasında çelişki hâlinde Türkçe metin esas alınır.

Madde 13 – Yürürlük
Kullanıcı, siparişi onaylamadan önce bu sözleşmeyi ve Ön Bilgilendirme Formu'nu okuduğunu ve kabul ettiğini elektronik ortamda onaylar. Sözleşme Arv. v1.0 sürümü olarak kayıt altına alınır.

Distance Sales Agreement (Candidate / Consumer)

Common definitions

1. Parties
1.1 Seller: ArveNova Software & Technology Ltd. (details above).
1.2 Buyer: the person holding an account on the Platform whose details appear in the order form ("User").

2. Subject
This agreement governs the rights and obligations relating to the Pro or Pro+ package purchased on the Platform. The Pre-Contractual Information Form forms an integral part of it.

3. Nature of the service
3.1 Pro (€14.99, VAT included): 2 Credits.
3.2 Pro+ (€34.99, VAT included): 5 Credits + a Detailed Career Report (strengths, development areas, competency breakdown, career report). The Detailed Career Report is shown only to the User.
3.3 Each Credit entitles the User to take one AI interview in a posting the User has applied to and for which the employer has enabled the AI interview channel. An AI interview is a video/voice conversation with an AI-powered avatar that the User can take at a time of their choosing.
3.4 The AI interview is an optional convenience. Applying, match scores, the employer's live (online) interview and in-person interviews at the company are free in every posting. The User is not required to choose the AI interview, and not choosing it does not negatively affect the application.
3.5 The score and report produced by the AI interview are provided to the employer for information only; they do not automatically change the status of the application or the ranking. The employer makes the hiring decision. The fact that the User purchased Credits is not shown to the employer and gives no ranking advantage.
3.6 ArveNova does not guarantee any hiring or placement.

4. Price and payment
4.1 Prices are shown in euros, VAT included.
4.2 Payment methods: (a) prepaid bank transfer/EFT/SWIFT on the web (the Bank Transfer Terms apply); (b) in-app purchase via the Apple App Store or Google Play in the mobile app (the relevant store's terms apply).
4.3 Price changes after purchase do not affect Credits already purchased.

5. Formation and performance
5.1 For bank transfers, the agreement is formed when the payment reaches our account and the order is confirmed. Credits are added and notified by email within 2 business days at the latest after the payment reaches our account.
5.2 For in-app purchases, Credits are added immediately once the store confirms payment.
5.3 This agreement, the Pre-Contractual Information Form and any statement you make regarding the withdrawal exception are sent to you by email as a PDF after the Credits are added and in any event before your first AI interview.

6. Use and validity of Credits
The Credit Terms (Text 5) apply. In short: Credits are valid for 12 months, are personal, non-transferable and not redeemable for cash. Your statutory refund rights are unaffected.

7. Right of withdrawal
7.1 You may withdraw within 14 days from the date the Credits are added, without giving reasons and without penalty.
7.2 Used Credits: The right of withdrawal ends for AI interviews started at your express request during the withdrawal period, with your acknowledgement that you will lose the right of withdrawal, and completed, and for a Detailed Career Report once provided. On withdrawal, their price is deducted and the price of unused Credits is refunded.
7.3 Notice: info@meetarven.ai, the withdrawal form at meetarven.ai/withdrawal-form, or written notice. You may use the model form in the Pre-Contractual Information Form.
7.4 Refund: within 14 days of receiving your notice, using the payment method you used and without any charge or deduction to you. For bank-transfer refunds, bank and SWIFT charges are borne by ArveNova.
7.5 Refund amount: If no Credits were used, the full amount paid. If partly used: for Pro, €7.495 per unused Credit; for Pro+, €5.99 per unused Credit plus €5.04 if the report was not provided (rounded to the nearest cent).
7.6 For in-app purchases, withdrawal and refund requests are made through the relevant store. Once the store issues a refund, the related unused Credits are removed from your account. If the store does not grant your withdrawal request, you may contact info@meetarven.ai; the refund is then made under Credit Terms s. 7. Your mandatory consumer rights are unaffected.

8. Cases where the Credit is restored
The relevant Credit is restored to your account if:
(a) due to a technical failure on our side, the interview fails to start, is interrupted or a report cannot be produced, and this is detected by us or reported by you;
(b) after the Credit is used and before the interview starts, the employer closes the posting or disables the AI channel.
This restoration concerns only the candidate's own Credit; no refund of any fee is made to the employer.
If you cannot use your Credit, you may request a refund (Refund Policy, Text 4).

9. User obligations
The User takes the AI interview in person; does not interview on behalf of others; does not secretly use another person's help or answer-generating tools; does not misuse the system; and does not record or publish the avatar or content.

10. Liability
AI outputs (scores, feedback, reports) are informational, do not replace professional career counselling and do not guarantee any particular hiring outcome. Liability that cannot be limited by law is unaffected.

11. Personal data
Your personal data is processed in accordance with the Privacy Notice (meetarven.ai/privacy-policy).

12. Governing law and disputes
12.1 This agreement is governed by TRNC law. This choice does not remove the protection of the mandatory consumer-protection rules of your country of habitual residence.
12.2 You may first raise complaints with info@meetarven.ai. Consumers resident in the TRNC may apply to the competent TRNC consumer authorities and courts.
12.3 Language. In case of conflict between the Turkish and English texts, the Turkish text prevails.

13. Entry into force
Before confirming the order, the User electronically confirms having read and accepted this agreement and the Pre-Contractual Information Form. The agreement is recorded as version Arv. v1.0.
